Ungovernable

If a child is ungovernable, prior to filing a complaint, the parent/guardian must provide written documentation from a counselor, or other service provider, that the child has refused to attend at least two (2) scheduled appointments, refused to take prescribed medication, or refused to follow a recommended course of treatment.

The court cannot place the child under an Order of Supervision without evidence that the child is refusing to receive counseling.  The filing of a petition results in the evaluation and assessment of the entire family as well as the child to determine the cause of the unruly behavior.
